1. Acceptance of Terms of Use 

Use of the Dessalines Excellence Foundation website implies full and complete acceptance of these terms and conditions of use. These terms and conditions may be modified or supplemented at any time without notice. Users are therefore invited to consult them regularly to be aware of any changes. 

2. Website Accessibility 

The site is normally accessible 24 hours a day, 7 days a week. However, the Dessalines Excellence Foundation reserves the right to interrupt access for technical maintenance reasons. In this case, we will endeavor to notify users in advance of the dates and times of the intervention. 

The site is updated regularly. Similarly, the legal notices may be modified at any time and are binding on the user, who is invited to refer to them frequently. 

3. Description of Services Provided 

The purpose of the Fondation l’Excellence de Dessalines website is to provide information about all the activities of the foundation and the L’Excellence de Dessalines school. 

The Foundation strives to provide information that is as accurate and up-to-date as possible. However, it cannot be held responsible for omissions, inaccuracies, or failure to update, whether caused by itself or by third-party partners providing this information. 

All information on the site is provided for informational purposes only and is subject to change. The information is not exhaustive and is subject to change since it was posted online. 

4. Technical Limitations 

The site uses current standard web technologies. 

The site cannot be held liable for any material damage related to its use. The user agrees to access the site using recent, virus-free equipment with a modern, up-to-date browser. 

5. Intellectual Property 

The Fondation l’Excellence de Dessalines Inc. owns or holds the rights to use all elements of the site, including: text, images, graphics, logos, icons, sounds, and software. 

Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the site, regardless of the means used, is strictly prohibited without the prior written authorization of the Dessalines Excellence Foundation Inc. 

Any unauthorized use will be considered an infringement and prosecuted in accordance with the provisions of the Intellectual Property Code. 

6. Limitation of Liability 

The Dessalines Excellence Foundation cannot be held liable for any direct or indirect damage caused to the user’s equipment when accessing the site, resulting either: 

  • The use of equipment that does not comply with technical specifications 
  • The occurrence of a malfunction or incompatibility 

The Foundation cannot be held liable for indirect damage (loss of data, loss of opportunity, interruption of activity) resulting from the use of the site. 

Interactive Areas 

Contact areas are made available to users. The Foundation reserves the right to delete, without notice, any content that contravenes applicable legislation in North America, Europe, or Haiti, particularly with regard to data protection. 

The Foundation also reserves the right to hold the user civilly and/or criminally liable in the event of racist, abusive, defamatory, or pornographic messages.
